U.S. Senators introduce bill to ban unauthorized AI replicas of actors, musicians

⚖️News - A group of U.S. Senators have introduced a bipartisan bill aimed at establishing a federal law to keep actors, musicians, and other entertainers safe from people making AI replicas of their faces or voices without their permission.

The Nurture Originals, Foster Art, and Keep Entertainment Safe Act of 2023, or the No Fakes Act, aims to standardize likeness laws at the national level. Basically, the act makes likeness rules the same across the entire country, rather than having different rules in each state.

🤨How does the bill ensure accountability? The bill prohibits the creation of a digital replica without permission from the relevant person or the holder of their rights. These rights would be in effect for an individual's entire life and extend to those who inherit their possessions for 70 years after the person's death.

Moreover, individuals themselves as well as those who inherited their estate or organizations like a record label, can take legal action based on the new rules. The bill also makes it clear that just adding a disclaimer saying ‘the digital replica was unauthorized’ won't be a good enough defense.

🤔Are there any exceptions though? The bill does include an exception that allows digital replicas to be used for parodies, satire, and criticism. The exception also applies to commercial activities such as advertisements, news, documentaries, sports broadcasts, or biographical works.

China's new guidelines include list of sources that cannot be used for training gen AI models

☕ News - China has released security guidelines for companies providing generative artificial intelligence services. These guidelines include a list of blacklisted or prohibited sources that can’t be used for training AI models.

⛔What type of content is prohibited ? The National Information Security Standardization Committee will be conducting security evaluations of all content that will be used in the training of generative Al models that are accessible to the general public. Any content found to contain "over 5% illegal and harmful information" will be added to the list of blacklisted sources.

Here, illegal or harmful information refers to information that promotes acts of violence and terrorism, as well as information that threatens the government-controlled political and economic system, in addition to any information that harms the nation's reputation and disrupts national unity and social stability.

Information removed or censored from the Chinese internet is also prohibited from being used to train AI models.

🧐What's more? The security guidelines further demand that organizations using personal data, including biometric data, to train AI models must obtain consent from individuals and follow the instructions provided to avoid intellectual property violations.

Google promises to protect Generative AI users from copyright lawsuits

♨️News - On Thursday, Google announced that it will protect users of generative artificial intelligence systems within its Google Cloud and Workspace platforms against allegations of copyright violations. Copyright violations are the unauthorized use of copyrighted material, such as books, movies, music, and software. This aligns with similar commitments made by other tech giants, such as Microsoft and Adobe.

Google stated that the new policy will cover software, including its Vertex AI development platform and Duet AI system responsible for generating text and images. However, Google's popular generative AI chatbot -Bard, was not mentioned.

🤷🏻‍♀️Why was this needed? This was necessary due to the increasing number of copyright-related challenges faced by generative AI platforms, which have resulted in a surge of lawsuits against various companies. While individual users have not been targeted yet, the lawsuits have certainly raised concerns.

The company has also mentioned that they won't provide protection if users purposely use the AI-generated content to violate someone else's rights. For example, if they use AI-generated text to create a book that includes passages copied from copyrighted novels with the intention of selling it as their own work.
